We, the below-named residents and property owners of Brigham City, hereby request that the Brigham City Council immediately rescind the Acknowledgement, Waiver and Consent signed by us agreeing to an assessment and lien (“Assessment and Lien”) on our property (Assessment Area No. 2009-1) in order for Brigham City to finance the construction by Utah Telecommunications Open Infrastructure Agency (“UTOPIA”) of certain infrastructure and related improvements in Brigham City. We make such request on the grounds that we were not given all pertinent and material information about the Assessment and Lien by the City or UTOPIA in order for us to make a knowing, informed and full consent of the Assessment and Lien.

-UTOPIA’s lien on your house MUST be paid, even if UTOPIA fails, you move in the future, or you no longer want to obtain services from a UTOPIA provider. - The $25 per month assessment means you will pay $6,000 over 20 years at nearly 8% interest. - If you do not pay the monthly assessments, your house may be sold at a foreclosure sale.
– If you sell your house, UTOPIA’s lien may be repaid BEFORE your mortgage s repaid.
– The lien on your home is just for a connection fee, and does not include telephone, TV or Internet fees.
Were you one of the 4,000 Brigham City residents who did not sign up for UTOPIA’s 20-year lien? How much will UTOPIA cost you?
– The City Council continues to increase the cost for taxpayers in Brigham City. UTOPIA initially promised that for the amount of the original bonds guaranteed by the City, every resident in Brigham City would get services. That promise was not kept.
– UTOPIA wants you to pay for the telephone, TV and Internet wiring for 1,604 homeowners who did sign up for UTOPIA’s 20 year lien.
– Brigham City taxpayers are on the hook to UTOPIA for $16.7 million over the next 30+ years. That’s $2,982 per household!
– The City Council agreed to pay another $665,000 to subsidize the 1.604 homeowners who did sign up for UTOPIA’s 20 year lien.
– The additional cost to taxpayers in Brigham City totals at least $5.5 million, just to get connected to the UTOPIA network… while UTOPIA is losing millions of dollars.
